
Shire of Chapman Valley Town Planning Scheme No.1, Local Planning Scheme No.2 and Buller Environmental Review
A Local Planning Scheme sets out a Council’s planning aims for an area that it is trying to achieve, and involves the zoning or classification of land. The Shire of Chapman Valley’s current Scheme (Town Planning Scheme No.1) is available for viewing at the Western Australian planning Commission website by clicking on the following link:

Schemes are required to be periodically reviewed, and Council resolved at its meeting held on 19 May 2010 to adopt the draft Shire of Chapman Valley Local Planning Scheme No.2 for advertising. Scheme No.2 was subsequently referred to the Environmental Protection Authority, as is required by the Environmental Protection Act prior to any advertising of the Scheme, who advised on 9 July 2010 that:
● Scheme No.2 should be assessed under Part IV Division 3 of the Environmental Protection Act relevant to the proposed Buller ‘Development’ zone as contained within Scheme No.2;
● the Buller ‘Development’ zone Environmental Review document has been prepared in accordance with the instruction of the Environmental Protection Authority and is approved for release;
● Scheme No.2 does not raise any additional environmental issues to those described in the instructions relevant to the Buller ‘Development’ zone, the Environmental Review for which is considered to be in accordance with those instructions.
Scheme No.2 was subsequently referred to the Western Australian Planning Commission, as is required by the Planning and Development Act, and the Commission issued consent to advertise Scheme No.2.
The Shire of Chapman Valley Local Planning Scheme No.2 and the Buller Environmental Review were jointly made available for public inspection and comment from 22 November 2010 until 23 February 2011. The Buller ‘Development’ Zone Environmental Review aspect of Scheme No.2 is currently awaiting a decision of the Minister of Environment, after which Scheme No.2 can be returned to Council for its further consideration and potential forwarding to the Western Australian Planning Commission and Minister of Planning for final determination.
